Meal and Entertainment Deduction Reduced Beginning after 1993, self-employed persons and employees who are not reimbursed, or who are reimbursed under a non-accountable plan, for meal and entertainment expenses will be able to deduct only 50 percent of those expenses. Meal and entertainment expenses are deductible if the expenditures can be substantiated and are directly related to, or associated with, the taxpayer's business. A meal or entertainment expenditure is directly related to a taxpayer's business if the taxpayer can show that there was some general expectation of deriving some income or specific benefit fomr the expenditure and that business was discussed or engaged in during the meal or entertainment. A taxpayer can also show that the expenditure is directly related to the business if it is provided in a clear business setting where the guest may recognize the business motive of the taxpayer in incurring the expenditure. A meal or entertainment is associated with a taxpayer's business if the meal or entertainment immediately precedes, or is followed by, a business discussion. Taxpayers can now deduct only 50 percent for tax years after 1993 of their business-related meal and entertainment expenses incurred while: (1) traveling away from home on business (whether eating alone or with others), (2) entertaining business customers at the taxpayer's place of business or at a restaurant or other location, or (3) attending a business convention or a reception, business meeting, or business luncheon at a club. This limit applies to employees or their employers and to self-employed persons, including independent contractors or their clients, depending on whether the expenses are reimbursed.
